Terms and Conditions

These Terms and Conditions (“Terms”) form a binding agreement between you and Jabir Builds (“we,” “us,” “our”), the studio operated by Jabir Bhuiyan. By accessing this website or contacting us through any channel listed here, you agree to these Terms and to our Privacy Policy.

If you do not agree, please do not use the site.

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use this site for commercial purposes. If you are using the site on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

You agree not to:

• Misuse, attack, or attempt to gain unauthorised access to the site or its systems.
• Use the site to transmit malware, spam, or other harmful content.
• Scrape or harvest data from the site without prior written permission.
• Reverse-engineer or copy proprietary parts of the site for resale.
• Submit information that is illegal, misleading, defamatory, or that infringes the rights of others.

Project scope, deliverables, timelines, and pricing are not finalised until set out in a written proposal or statement of work signed by both parties. The website's descriptions of services are informational and do not constitute an offer or contract.

You agree to provide the access, content, and approvals needed for us to do the work in a timely way. Delays from your side may shift the delivery schedule.

Fees, payment milestones, and invoicing terms are set out in your project agreement. Unless otherwise agreed:

• Projects begin once an initial deposit (typically 30–50%) is received.
• Invoices are due within 14 days of issuance.
• Late payments may incur reasonable interest at the rate permitted by law.
• Third-party costs (hosting, paid plugins, stock assets) are passed through at cost or billed separately.

The Jabir Builds name, logo, website, and underlying code are owned by Jabir Builds. You may not use them for commercial purposes without permission.

For client work, ownership of the deliverables transfers to you after full payment, except for: (a) third-party assets we license on your behalf, (b) generic frameworks, libraries, and tools we use across projects, and (c) our internal know-how and process documents. We retain a non-exclusive right to display the work in our portfolio and marketing.

You keep ownership of any text, images, logos, and other materials you provide. By sharing them with us, you grant us a limited licence to use them solely to deliver the project. You confirm that you have the rights to share that content with us.

Our site may link to third-party websites or use third-party tools (such as analytics, hosting, or CMS providers). We are not responsible for the content, terms, or privacy practices of those third parties. Your use of their services is subject to their own terms.

The website is provided on an “as is” and “as available” basis. We do everything we reasonably can to keep it working, but we don't guarantee that it will be uninterrupted, error-free, or completely secure. Any information presented is for general guidance only and is not professional advice for your specific situation.

To the fullest extent permitted by law, Jabir Builds will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising from your use of the site or our services. Our total liability for any claim related to this site is limited to the greater of the fees you paid us in the 12 months preceding the claim, or USD 100.

Some jurisdictions do not allow these limitations. In that case the limits apply only to the extent permitted by law.

We may suspend or end your access to the site if you breach these Terms or use the site in a way that risks its operation. Either party may end an active project agreement under the conditions set out in that agreement. Sections of these Terms that by their nature should survive termination (such as fees owed, intellectual property, disclaimers, and limitations of liability) will continue to apply.

These Terms are governed by the laws of Bangladesh, without regard to its conflict-of-laws principles. We'll always try to resolve disputes amicably first. If that's not possible, the courts of Dhaka, Bangladesh have exclusive jurisdiction, unless local consumer protection law gives you the right to bring a claim where you live.

We may update these Terms from time to time. The current version is always available at this URL with a clearly stated effective date. Substantial changes will be highlighted on the homepage. By continuing to use the site after changes go into effect, you agree to the updated Terms.
